    I recently read this article in which mufti taqi usmani says “It appears by looking into the book “al-Umm” of Imam Shafi’i that he did not explicitly mention the lawfulness of the animal on which the name of Allah is not pronounced, rather he only stated that the animal on which the name of Allah was not pronounced forgetfully would be lawful (halal)” I remember reading here in one of the discussions that according to imam shafi tasmiyya is not obligatory for meat to be considered halal. Can someone please explain what exactly is Imam shafi point of view and what do people of that fiqh practice today?And also is it required to say the name of Allah on every individual animal or we can do tasmiyya for multiple animals at once?

    The ‘Halal Laws’ according to the Quran are as followed,

    “He (God) has forbidden to you only what died itself (having not been slaughtered before it died), as well as drained blood, swine flesh, and that over which any name other than God’s has been invoked. Whoever falls into a state of necessity (and eats) without coveting anybody’s right or exceeding the limits of necessity, there is no sin upon them. Surely God is forgiving and beneficent.” (Al-Baqarah 2:173)

    Further detail is given in the following verse:

    “Forbidden to you is carrion, and blood, and the flesh of swine, and that over which any name other than God’s has been invoked, and the animal that has been strangled, or beaten to death, or killed by a fall, or gored to death, or savaged by a beast of prey, save that which you may have slaughtered while it was still alive; and [forbidden to you is] all that has been slaughtered on idolatrous altars.” (Al-Maida 5:3)

    “Say, ‘I do not find in the revelations given to me any food that is prohibited for any eater except: carrion, running blood, the meat of pigs, for it is contaminated, and the meat of animals blasphemously dedicated to other than God.’ If one is forced (to eat these), without being deliberate or malicious, then your Lord is Forgiver, Most Merciful.” (6:145)

    The aforementioned verse is also found in 16:115 of the Quran

    Keep in mind, the Quran says that God is displeased with those who prohibit anything that was not specifically prohibited in the Quran, which is mentioned right after the verse above.

    “You shall not utter lies with your own tongues stating: “This is lawful, and this is unlawful,” to fabricate lies and attribute them to God. Surely, those who fabricate lies and attribute them to God will never succeed” (16:116).

    These practices are the things that make food Halal or haram, saying Bismillah is simply a Sunnah. Inshallah this helps you.

    This is generally understood that Imam Shafi’i is the opinion the pronouncement of Tasmiya is not required, however, it is good to pronounce it while slaughtering an animal. The rest of the Ummah unanimously agrees that the pronouncement of Tasmiya is obligatory, except when one forgets it.

    There seems no objection to saying Tasmiya once on the occasion of slaughtering multiple animals.

    In the above video, Ghamidi sahib explains how imam shafi differs from others when tasmiyya is not being performed, but reading this it seems he has the same opinion as others that it will be lawful only when it happens by mistake

    As far as Imam Shafi’i (Allah have mercy on him) is concerned, it is usually related from him that the animal will be lawful to consume even when one does not pronounce the name of Allah intentionally, and that to pronounce the name of Allah is merely a Sunnah.

    However, the great contemporary jurist, Shaykh Mufti Taqi Usmani (may Allah preserve him) discusses the viewpoint of Imam Shafi’i (Allah have mercy on him) in his Arabic treatise “Ahkam al-Dhaba’ih” concluding that this is only when it occurs infrequently. If a habit is made of not pronouncing the name of Allah due to negligence and taking the matter lightly, the animal would not be lawful according to the Shafi’i school also.

    Shaykh Taqi Usmani (may Allah preserve him) states:

    “It appears by looking into the book “al-Umm” of Imam Shafi’i that he did not explicitly mention the lawfulness of the animal on which the name of Allah is not pronounced, rather he only stated that the animal on which the name of Allah was not pronounced forgetfully would be lawful (halal). The text of Imam Shafi’i (Allah have mercy on him) is as follows:

    “When a Muslim sends his (hunting) dog or bird, both of which are trained (to hunt), I would prefer that he pronounces the name of Allah. If he did not pronounce the name of Allah forgetfully, and the animal was hunted, then it would be Halal to consume from it….” (Kitab al-Umm, 2/227)

    Further along, Imam Shafi’i (Allah have mercy on him) clearly states that the one who does not pronounce the name of Allah by taking the matter lightly, then the animal slaughtered by him would not be lawful. He states:

    “If a Muslim forgets to pronounce the name of Allah Most High, the slaughtered animal is Halal to consume. However, if he did not pronounce the name of Allah by taking the matter lightly (istikhfafan), then the slaughtered animal will not be lawful to consume.” (al-Umm, 2/131, Bab Zaba’ih ahl al-Kitab)

    These texts of Imam Shafi’i quite clearly illustrate that the Shafi’i school does not give a general permissibility of consuming from animals on which the name of Allah was not pronounced intentionally, rather, the slaughtered animal will be unlawful (haram) in the Shafi’i Madhhab also if the name of Allah (tasmiyah) was not pronounced due to being negligent or taking the matter casually and lightly, and that one make this a habit.”
