  • Zakat On Household (Collective Zakat And Zakat On Behalf Of Wife)

    Salam,

If both husband and wife are working, should they calculate Zakat separately, or can it be done collectively based on household income?

I pay around 30% in income tax, while my wife pays less than 10%. Additionally, she owns gold (kept in Pakistan) that is not in use. The country we live in has a high Nisab threshold for wealth tax, which we do not meet based on our cash and assets here—even if we include the gold.

Considering that my 30% income tax already exceeds the Zakat amount when viewed collectively, does my wife still need to calculate Zakat separately on her income (to match 10%) and gold? If so, can I contribute to her Zakat obligation?

There is some ambiguity in the question which requires clarification. If both husband and wife have not met Nisab threshold for Zakat then there is no Zakat obligation on them.

As a general principle however, whatever extra tax that is being paid by either of them which is over and above their zakat obligation, can be carried forward in the future years for adjustment against Zakat obligation of the future, if any. Husband is liable for his Zakat and Wife is liable for her Zakat, subject to Nisab.

Wife should pay the zakat on the gold she owns (which cannot be categorized as item of personal use). If both husband and wife are clear that gold is her ownership then the burden to pay zakat is upon her. If husband decides to pay on her behalf then she is released of the obligation otherwise she has to pay the zakat due on it.

    Understood.

Just one thing is not clear. If my wife has paid 8% tax from her income throughout the year, can my overpaid tax adjust her remaining 2%? Or she is liable to pay?

If the husband is paying zakat (completely or partially) on his wife’s behalf, then his overpaid tax can be used for the adjustment.

Can you kindly provide the argument for why a husband is allowed to pay off his wife’s zakat from his tax deductions?

If a husband chooses to pay Zakat in cash on behalf of his wife, then he may likewise choose to designate taxes already paid as her Zakat. The only practical difference between the two is the timing: cash Zakat is assigned at the moment of payment, whereas tax payments are assigned retroactively. In both cases, the payments themselves already exist; what changes is the husband’s decision about how those payments are to be applied.
