    Assalamoualaikum,

I’m from India and stuck in a situation between adament parents and teaching of my religion, the parents of the girl i like are not willing to agree for our marriage and I don’t want to go against the teaching of our religion, what shall I do in this situation? Knowing that my religion gives us permission for nikah with the person we like. The parents of the girl i like are more concerned about the society and what other will say. Please suggest a way in between as we both are ageing for just them to agree.

Nikah is essentially an agreement between man and woman. Parents and guardians are facilitators and advisors. Everyone should know their status and responsibility. If there is a disagreement it should be resolved with mutual consultation. If the parties do not reach an agreement the law allows you to marry her without the consent of the parents. But it has social consequences.

Thankyou very much Dr.Irfan for your suggestion, I’m aware that the law gives me permission to marry her but that nikah will not be valid from the islamic point of view. And there is no way that we come to a mutual understanding and get going with this. What I want to know whether there is a solution from islamic point of view, where our nikah is valid and halal.

I mean Islamic law allows you to get married without the consent of parents. However, ethically, one should have a valid reason for not seeking the consent of parents.

Here in India we don’t have Islamic law, I’m very disturbed and disappointed to understand to my knowledge that Islam has no way out form this situation. Why is there no teaching from our Nabi(pubh) or any teaching from Quaran?

I didn’t understand your dissatisfaction. Everything is clearly told.

Indian allows you to marry according to Islamic law and Islamic law allows you to marry. So what is the issue now?

I really appreciate your suggestion, but my confusion is that, does islamic law allows a girl to do nikah without wali and if it does then will that nikah be valid(halal) in islam keeping in consideration that without wali nikah is not permissible.

What I understood from Dr Irfan’s response, he’s saying that in Islam, Nikah without wali is valid, if there’s a genuine reason for it. And the girl does seem to have the genuine reason for it. But from society’s point of view, there are some consequences of that, which you are probably already aware of.

Social stigma and societal pressures are real in south asian cultures. Parent’s concerns are valid as we live in such kind of society where these things matter. My suggestion is not to rush to marriage but instead give yourself time to think. Perform Dua-e-Istikhara regularly after Nafl prayers and you will get the guidance from Allah SWT.

    Assalamoualaikum Shaheen,

Tell me till when shall I wait?I’m 38 now do I still need to wait more for them to agree knowing what they are doing is just ego and stubbornness.

The last question in this thread I asked remains unanswered.
