@Umer25 brother this is what I was thinking as well. Because when it comes to legal punishment, like theft, Zina. All these only are under discussion when the matter reaches court, so I thought similarly this should happen as well.
But one ayah confused me that in ayah where qisas is discussed. Surah baqarah 178
“O you who have believed, prescribed for you is legal retribution for those murdered – the free for the free, the slave for the slave, and the female for the female. But whoever overlooks from his brother anything, then there should be a suitable follow-up and payment to him with good conduct. This is an alleviation from your Lord and a mercy. But whoever transgresses after that will have a painful punishment.”
Words starting from “O you have believed..” This made me feel that is it fard on an individual level, that the victim and the offender both are individually obliged to go to court and do diyah? Because in other prescription of hudud, there wasn’t such words used. In this ayah “ya ayyuhallazina” Are used, I myself got a thought what if this addressee is not the state but the individual people?
