    Yes i know there are some scholars that say it’s halal to live in a non-muslim country as long as you can freely practice your religion but there are some hadith that some people say that it’s haram to live in a non-muslim

    Sunan Abi Dawud 2645

    The Messenger of Allah (ﷺ) sent an expedition to Khath’am. Some people sought protection by having recourse to prostration, and were hastily killed. When the Prophet (ﷺ) heard that, he ordered half the blood-wit to be paid for them, saying: I am not responsible for any Muslim who stays among polytheists. They asked: Why, Messenger of Allah? He said: Their fires should not be visible to one another.

    Abu Dawud said: Hushaim, Ma’mar, Khalid b. al-Wasiti and a group of narrators have also narrated it, but did not mention Jarir.

    حَدَّثَنَا هَنَّادُ بْنُ السَّرِيِّ، حَدَّثَنَا أَبُو مُعَاوِيَةَ، عَنْ إِسْمَاعِيلَ، عَنْ قَيْسٍ، عَنْ جَرِيرِ بْنِ عَبْدِ اللَّهِ، قَالَ بَعَثَ رَسُولُ اللَّهِ صلى الله عليه وسلم سَرِيَّةً إِلَى خَثْعَمٍ فَاعْتَصَمَ نَاسٌ مِنْهُمْ بِالسُّجُودِ فَأَسْرَعَ فِيهِمُ الْقَتْلُ – قَالَ – فَبَلَغَ ذَلِكَ النَّبِيَّ صلى الله عليه وسلم فَأَمَرَ لَهُمْ بِنِصْفِ الْعَقْلِ وَقَالَ ‏”‏ أَنَا بَرِيءٌ مِنْ كُلِّ مُسْلِمٍ يُقِيمُ بَيْنَ أَظْهُرِ الْمُشْرِكِينَ ‏”‏ ‏.‏ قَالُوا يَا رَسُولَ اللَّهِ لِمَ قَالَ ‏”‏ لاَ تَرَاءَى نَارَاهُمَا ‏”‏ ‏.‏ قَالَ أَبُو دَاوُدَ رَوَاهُ هُشَيْمٌ وَمُعْتَمِرٌ وَخَالِدٌ الْوَاسِطِيُّ وَجَمَاعَةٌ لَمْ يَذْكُرُوا جَرِيرًا ‏.‏

    Sunan Ibn Majah 2536

    “Allah (SWT) will not accept any good deed from a polytheist who committed polytheism after having become Muslim, until he leaves the polytheists and joins the Muslims.”

    حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا أَبُو أُسَامَةَ، عَنْ بَهْزِ بْنِ حَكِيمٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ “‏ لاَ يَقْبَلُ اللَّهُ مِنْ مُشْرِكٍ أَشْرَكَ بَعْدَ مَا أَسْلَمَ عَمَلاً حَتَّى يُفَارِقَ الْمُشْرِكِينَ إِلَى الْمُسْلِمِينَ ‏”‏ ‏.‏

    Sunan An-Nasa’i 4177

    “I came to the Prophet when he was accepting (the people’s) pledge, and said: ‘O Messenger of Allah, extend you hand so that I may give you my pledge, and state your terms, for you know best.’ He said: ‘I accept you pledge that you will worship Allah, establish Salah, pay the Zakah, be sincere toward the Muslims, and forsake the idolaters.”

    أَخْبَرَنِي مُحَمَّدُ بْنُ قُدَامَةَ، قَالَ حَدَّثَنَا جَرِيرٌ، عَنْ مَنْصُورٍ، عَنْ أَبِي وَائِلٍ، عَنْ أَبِي نُخَيْلَةَ الْبَجَلِيِّ، قَالَ قَالَ جَرِيرٌ أَتَيْتُ النَّبِيَّ صلى الله عليه وسلم وَهُوَ يُبَايِعُ فَقُلْتُ يَا رَسُولَ اللَّهِ ابْسُطْ يَدَكَ حَتَّى أُبَايِعَكَ وَاشْتَرِطْ عَلَىَّ فَأَنْتَ أَعْلَمُ ‏.‏ قَالَ ‏ “‏ أُبَايِعُكَ عَلَى أَنْ تَعْبُدَ اللَّهَ وَتُقِيمَ الصَّلاَةَ وَتُؤْتِيَ الزَّكَاةَ وَتُنَاصِحَ الْمُسْلِمِينَ وَتُفَارِقَ الْمُشْرِكِينَ ‏”‏ ‏.‏

    Sunan Abu Dawud 2479

    I heard the Messenger of Allah (ﷺ) say: Migration will not end until repentance ends, and repentance will not end until the sun rises in the west.

    حَدَّثَنَا إِبْرَاهِيمُ بْنُ مُوسَى الرَّازِيُّ، أَخْبَرَنَا عِيسَى، عَنْ حَرِيزِ بْنِ عُثْمَانَ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي عَوْفٍ، عَنْ أَبِي هِنْدٍ، عَنْ مُعَاوِيَةَ، قَالَ سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏ “‏ لاَ تَنْقَطِعُ الْهِجْرَةُ حَتَّى تَنْقَطِعَ التَّوْبَةُ وَلاَ تَنْقَطِعُ التَّوْبَةُ حَتَّى تَطْلُعَ الشَّمْسُ مِنْ مَغْرِبِهَا ‏”‏ ‏.‏

    So because of these hadith is it haram or halal to live in a non-muslim country?

    After the itman e hujjat of the prophet, the disbelievers had to be punished by God. This was the rule. Thefore all the Muslims were obliged to migrate to Madina. This doesn’t apply to others.

    The principle is, everything is allowed, except for what is prohibited. Allowance does not require a verse of hadith, but prohibitation does.

      It was narrated that ‘Abdullah bin As-Sa’di said:

      “We came in a delegation to the Messenger of Allah and my companions entered and asked their questions. I was the last of them to enter, and he said: ‘What is you question?’ I said: ‘O Messenger of Allah, when will emigration end?’ The Messenger of Allah said: ‘Emigration will not cease so long as the disbelievers are being fought.”‘

      أَخْبَرَنَا مَحْمُودُ بْنُ خَالِدٍ، قَالَ حَدَّثَنَا مَرْوَانُ بْنُ مُحَمَّدٍ، قَالَ حَدَّثَنَا عَبْدُ اللَّهِ بْنُ الْعَلاَءِ بْنِ زَبْرٍ، قَالَ حَدَّثَنِي بُسْرُ بْنُ عُبَيْدِ اللَّهِ، عَنْ أَبِي إِدْرِيسَ الْخَوْلاَنِيِّ، عَنْ حَسَّانَ بْنِ عَبْدِ اللَّهِ الضَّمْرِيِّ، عَنْ عَبْدِ اللَّهِ بْنِ السَّعْدِيِّ، قَالَ وَفَدْنَا عَلَى رَسُولِ اللَّهِ صلى الله عليه وسلم فَدَخَلَ أَصْحَابِي فَقَضَى حَاجَتَهُمْ وَكُنْتُ آخِرَهُمْ دُخُولاً فَقَالَ ‏”‏ حَاجَتُكَ ‏”‏ ‏.‏ فَقُلْتُ يَا رَسُولَ اللَّهِ مَتَى تَنْقَطِعُ الْهِجْرَةُ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏”‏ لاَ تَنْقَطِعُ الْهِجْرَةُ مَا قُوتِلَ الْكُفَّارُ ‏”‏ ‏.‏

      what about these hadiths? what is the explanation on the meaning of “so long as the disbelievers are being fought”

    It is about the disbelievers of Arabia. When Makkah was conquered, the migration ended, and the disbelievers were subdued.

      “Ubaid bin Umar Al-Laithi and I visited Aisha and asked her about the Hijra (i.e. migration), and she said, “Today there is no (Hijrah) emigration. A believer used to run away with his religion to Allah and His Messenger lest he should be put to trial because of his religion. Today Allah has made Islam triumphant, and today a believer can worship his Lord wherever he likes. But the deeds that are still rewardable (in place of emigration) are Jihad and good intentions.” [577]

      Al-Imam An-Nawawi said in the explanation of Sahih Muslim, volume 9, pages 127-128, “The Scholars have said making Hijrah from the land of war to the land of Islam remains until the Day of Resurrection, and there are two positions concerning the explanation of this Hadith:

      One is that there is no Hijrah after the conquest from Makkah because it became a land of Islam and Hijrah is only from the land of war. And this contains a miracle for the Messenger of Allah (ﷺ) in that it will remain a land of Islam from which making Hijrah is not imaginable.

      The second is that it means there is no Hijrah after the conquest, its excellence being like the excellence before the conquest as Allah said:

      “Not equal among you are those who spent before the conquest and fought (and those who did so after it.) Those are greater in degree than those who spent afterwards and fought. But to all Allah has promised the best (reward). And Allah knows what you do.” (Surah Al Hadeed: 10)

      Al-Hafidh Ibn Hajar said in Fathul-Baari, volume 4, page 47, “The meaning is that the obligation of making Hijrah from Makkah ceased with its conquest because it became a land of Islam…” End quote.

      The Prophet (ﷺ) clarified in many Ahadith that Hijrah from the land of disbelievers to the land of Islam will not cease till the Day of Judgement:

      It was narrated that ‘Abdullah bin Waqdan As-Sa’di said:

      “We came in a delegation to the messenger of Allah, each of us with a question to ask him. I was the last of them to come in to the Messenger of Allah, and I said: ‘O Messenger of Allah, I have left people behind me, and they are saying that emigration (Hijrah) has ceased.’ He said: ‘Emigration will not cease so long as the disbelievers are being fought.” [579]

      Narrated Mu’awiya bin Abi Sufyan:

      I heard the Messenger of Allah (ﷺ) say: “Migration will not end until repentance ends, and repentance will not end until the sun rises from the west”. [580]

      Shaikh Saalih Al-Fawzan said: “…what is meant by there is no migrating after the conquest” is (no migrating) from Makkah, since through the conquest, it became an abode of Islam. The people thought that migrating remained from Makkah after the conquest so they wished to attain the reward of migrating. As for migrating from the land of disbelief, then it remains until the Hour is established. End quote. [581]

      Shaikh Muhammad bin ‘Abdul Wahhab said:

      “Hijrah, from the land of shirk to the land of Islam, is an obligation upon this nation (Ummah) and it continues until the Hour is established”. [582]

      but isnt the hadith only abrogating hijrah from mecca and not from everywhere because mecca became a non-muslim land so how did hijrah end and where is the proof
