Nikkah And Divorce In Joking/Non-Seriousness
Assalam-o-Alaikum
I heard the View of Sir Javed Ahmad Ghamidi on Nikkah or divorce in joking/non seriousness.
He says Nikkah or divorce does not take place in joking serious intention is required.
Can you explain the Hadith regarding this matter
hadith of Prophet PBUH “Three things done in a joke (mazaak) are to be considered reality; Divorce, Nikkah and the freeing of slaves”.

He clearly said in this hadith it will be done in reality. Why he said so? What’s the actual meaning of it
please try to explain in easy wording

“There are three matters that are considered serious in both serious and non-serious talk: marriage, divorce, and returning a wife who was divorced a non-terminal divorce. “

In principle, every such act (Nikah, Divorce) needs to be intended seriously to get its validity, that is why non-serious or habitual swearing upon God is not subject to kaffara or accountability- it needs serious intent. However if it is taken to the court, the court can decide otherwise because such serious matters should never be subject to non-seriousness.
The saying of the prophet (sws) in this regard indicates the intent of law, which has authority to validate it, if it so chooses after considering all the circumstances of the case.
