  • Use Of Pirated Software By Third-party Contractors For Design Work

Posted by Rehman Ali on November 11, 2022 at 3:40 am

Assalamu Alaikum. I have a question that if we want to start our work, such as proofreading work, website development and logo design work. And we are from Pakistan where Adobe products (photoshop, illustrator) cannot be directly purchased through the website. Instead, their official third-party resellers sell them but in high rates.

If this person believes 95% of the people here might not be using licensed Adobe software and Microsoft windows, can this person still get graphics design work?

Will this make the person income haram who is fulfilling all the work (proofreading, design and development services) just because he got the design work from people who might not be using licensed software?

Also, please help me understand how much a man would be considered accountable in these cases? Should a man only see what he is doing, either doing his work earnestly or not? Or does he also need to see if he is taking some services (by paying) the service provider is actually using authentic licensed software or not?

    Please reply.

Look at the following question for digital piracy

    Discussion 29776

Try to use free and open source software where possible if you can’t afford the more famous. Like Inkscape instead of Illustrator, Gimp instead of Photoshop and Blender instead of 3D Studio Mad

Kausar, brother I am not using pirated software. I am asking about taking logo, social media posts and other graphics design work from OTHERS who might not be having licensed microsoft windows, licensed adobe products etc.

Your question is confusing. If I understand correctly, you are asking whether or not you are liable to make sure that the software used by your contractors is legally purchased or not. In that case the answer is ‘no’. You will be held accountable for your own actions while yours contractors for theirs.

If, on the other hand, your question was regarding your own use of illegal software then the discussion shared by Kausar sahab above should answer your question.

Assalamu Alaikum. My question is simple: I know majority of the people here do not have licensed Microsoft windows, and licensed Adobe software for graphics design. I want to know if I take their service, such as logo, social media posts for MY WORK/ COMPANY etc, will this action make my income also haram even if I deliver my work 100% to clients? or is it halal for me to take their graphics design service for my work?

There are also 2 thoughts bothering me:

      1) Some said, don’t ask these questions otherwise you cannot even take bread and butter from others, as you will ask them if the equipment or material they are using is their own or acquired through theft etc. Which I THINK IS A GOOD ANSWER TO MY QUESTION.

      2) But, then I think, what if I know there is a market where stolen products are sold, and if I purchase things from that market then it will not be halal, right? so, are these 2 scenarios (theft market and people using pirated software) are the same or both are two different things?

I will really thank you all for answering my questions. Please do not ignore my questions.

As explained above, you are only accountable for your own deeds. If your service provider or contractor uses pirated copies of any software to do some work for you then you are not liable for their deeds. If you buy a stolen product yourself then you will be held accountable for knowingly committing a sinful deed.
