    Assallam u alaikum hello there, my question is that.

    Keeping in mind the criteria of being a Muslim and being identified as Muslims at the time of prophet, which was namaz and zakat after a person professes faith.

    so is it obligatory or if not obligatory then permissible, for a Muslim state to deprive someone of rights exclusively for Muslims? if someone says he’s Muslim but doesn’t pray, would they be recognized as Muslims now and hence given access to those rights?

    Not obligatory but permissible. However it’s a purely an administrative matter how the state wants to implement it.

    so sir if that state makes a rule that whoever does not pray would not be given rights exclusively for Muslims. which means that they won’t be recognized as Muslims. so wouldn’t it be a sort of takfir? similar to the case where someone says that’s one who believes in wahdatul wajood won’t be recognized as Muslims (similarly a person who isn’t praying normally, won’t be recognized as Muslim)

      It is an administrative matter whether a Muslim government wants to deal with this issue or not and if yes, then how it wants to deal with it. They will not be categorized as Kafir or Non-Muslims, rather their rights as Muslims could be put in abeyance until conditions of Salah and Zakat are met.
