    The answer seems simple to me. When the ‘action’ is a belief or thought then the ‘actor’ cannot be judged. So take two examples:

    A. Mr. X is a Muslim who believes murder is not a sin. A court cannot judge him to be a non-Muslim or punish him for being a murderer.

    B. Mr. Y is a Muslim who believes murder is not a sin and kills someone. A court still cannot declare him a non-Muslim but certainly will pronounce a punishment – jail or hanging.

    Therefore, the act determines if a court has authority over passing judgement over the actor. If the ‘act’ is merely a thought or a belief then it is for Allah to decide if the person was wrong to think that or if he had experiences that justified his thinking and therefore can be forgiven.

    I think that is the distinction Ghamidi Sahib always tried to make. And I agree with him.

    Also, Dr. Sajid Hameed from Al-Maurid in one of his classes answered exactly the same question as the one in the video. Not sure if I can explain Dr. Hameed’s answer and example as beautifully as he did but I’ll try.

    Dr. Hameed said (about the logic of Fa-il and Maf-oom)

    “My mother used to write weekly letters to my brother. So grammatically I can correctly say “my mother writes/is a writer” but does this mean she is a writer in the sense of an author of published books? Obviously no. Therefore the ‘Fa-il’ ‘maf-oom’ logic cannot be taken so simplisticly A person doing kufr is doing just that – a kufr – to assume he is a kafir because of that kufr, is not correct and is not for us to state and only Allah will make a ruling on it.

    There is a lot of difference between the two one is related to the basic concept or belief system of the religion where as the other one is pertaining to the individual beliefs or claims hence later one is a matter relating to Almighty Allah Swt and his servant other than Almighty Allah Swt No has any say in this matter or deny his faith or claim
