    The purpose of state laws is to protect human life, property, and honour and to prevent human rights violations, for which the state also takes preventive measures like traffic laws. According to Professor ghamidi, the state can not interfere in personal matters unless it poses a threat to human life, property, reputation, or causes violation of rights. On the same basis, professor ghamidi declares the state laws for veiling of women to be baseless and interference in personal rights, but on the other hand, when professor ghamidi was asked in a 23 Question series that, “those massage centers where women massages men, There is a risk of committing adultery and because adultery is considered as a violation of right, so if the state should stop it on the basis of preventive measure, what is your opinion?” To which Professor ghamidi replied that the state can block the ways that leads the violation of rights as was done in the case of traffic laws. The same was the answer given by Professor ghamidi about making a state law to prevent a boy and a girl from meeting alone in a park or in a public place to avoid adultery. The question is that if the state can make such preventive laws on mutual consentual interpersonal matters (though they are not commiting any adultery) then why state can’t make a preventive law as a specific dress code for women veiling? While there were the same basis of the problems mentioned above and which was answered in agreement by Professor ghamidi??




    ریاستی قوانین کا مقصد انسان کی جان، مال اور آبرو کی حفاظت اور حق تلفی کو روکنا ہے جس کے لئے ریاست پریونٹِو میژرز بھی کرتی ہے جیسا کہ ٹریفک قوانین۔ غامدی صاحب کے مطابق ریاست شخصی معاملات میں مداخلت نہیں کرسکتی جب تک کہ وہ انسانی جان، مال، آبرو کے لئے خطرہ نہیں بنتی یا حق تلفی کا سبب نہیں بنتی۔ اسی بنیاد پر غامدی صاحب خواتین کے پردے کے لئے بنائے گئے مخصوص ریاستی قوانین کو بےبنیاد قرار دیتے ہیں مگر دوسری ہی طرف غامدی صاحب سے ایک نشست میں جب پوچھا گیا کہ “وہ مساج سینٹرز جہاں خواتین مردوں کے مساج کرتی ہیں، ان میں زنا کے ارتکاب کا خطرہ رہتا ہے اور کیونکہ زنا حق تلفی میں شمار ہوتا ہے لہٰذا اگر ریاست پریونٹِو میژر کی بنیاد پر وہ بند کروادیں تو کیا رائے ہے آپ کی؟” جس پر غامدی صاحب نے جواب دیا کہ ریاست حق تلفی کی طرف جانے والے رستوں کو روک سکتی ہے جیسا کہ ٹریفک قوانین کی صورت میں کیا گیا۔ یہی جواب غامدی صاحب نے لڑکا اور لڑکی کے اکیلے پارک میں یا کسی پبلک پلیس میں ملنے کے سے روکنے کے لئے ریاستی قانون بنائے جانے پر دیا۔سوال یہ ہے کہ اگر ریاست سدِ ذریعہ کے اصول پر اگر اس قسم کے باہمی شخصی معاملات میں دخل دے سکتی ہے تو خواتین کے لئے مخصوص ڈریس کوڈ کے لیے کیوں نہیں کرسکتی؟ جب کہ یہاں بھی وہی بنیاد ہے جن کا ذکر مندرجہ بالا کیا گیا اور جن کا جواب غامدی صاحب نے اثبات میں دیا؟؟

    A state has the authority to regulate nudity and obscenity. However, the matter of veiling is a personal one. Veiling refers to wearing additional garments (such as a chadar or abaya) when a woman has adorned herself with makeup or jewelry. If she has not done so, she is not required to wear a veil and can dress in normal, modest clothing.

    God directly addressed women regarding the practice of veiling, which clearly suggests that the state has no role in this matter. The state’s authority in religious obligations is limited to two areas: the establishment of prayer and the collection of Zakat, as indicated in verse 22:41:

    الَّذِينَ إِن مَّكَّنَّاهُمْ فِي الْأَرْضِ أَقَامُوا الصَّلَاةَ وَآتَوُا الزَّكَاةَ وَأَمَرُوا بِالْمَعْرُوفِ وَنَهَوْا عَنِ الْمُنكَرِ ۗ وَلِلَّهِ عَاقِبَةُ الْأُمُورِ

      So a state can dictate a woman if she had worn short skirts or sleeve-less shirts or a shirt in which cleavage is explicit because it is counted in nudity and obscenity? As you mentioned that a state has the authority to regulate nudity and obscenity.
