    I’ve listened to Ghamidi sahab describing that the jummah prayer is jurisdiction of the political system. Only the ruler can sanction it and it doesn’t belong to mullahs. The ruler shall appoint his representatives.

    Another thing that I notice is that he emphsaizes that it’s common knowledge. Like every student of Islamic law and History would know that fact. But I’ve seen many people criticizing this view of his.

    My question :

    is it a new concept by syedna Ghamidi himself or it’s common among the past scholars and if it so, then can u refer me to the sources that can substantiate the fact.

    «المبسوط» للسرخسي (2/ 25):

    (ولنا) ما روينا من حديث جابر رضي الله عنه «وله إمام جائر أو عادل» فقد شرط رسول الله صلى الله عليه وسلم الإمام لإلحاقه الوعيد بتارك الجمعة وفي الأثر «أربع إلى الولاة منها الجمعة» ولأن الناس يتركون الجماعات لإقامة الجمعة ولو لم يشترط فيها السلطان أدى إلى الفتنة لأنه يسبق بعض الناس إلى الجامع فيقيمونها لغرض لهم وتفوت على غيرهم وفيه من الفتنة ما لا يخفى فيجعل مفوضا إلى الإمام الذي فوض إليه أحوال الناس والعدل بينهم لأنه أقرب إلى تسكين الفتنة.

    (And for us) is what we have narrated from the hadith of Jabir, may Allah be pleased with him: ‘Whether the imam is just or unjust.’ The Messenger of Allah, peace and blessings be upon him, conditioned the presence of the imam by attaching a warning to the one who abandons Jumu’ah. Additionally, in the report: ‘Four matters are entrusted to the rulers, among them is Jumu’ah.’ This is because people leave the congregational prayers to perform Jumu’ah, and if the presence of the ruler were not a condition, it could lead to discord. Some people might rush to the mosque and hold it for their own purposes, depriving others, which could cause unrest. This risk of discord is clear, so the matter is entrusted to the imam, who has been assigned the responsibility of overseeing the people’s affairs and ensuring justice among them, as he is better positioned to prevent such conflicts.”

    Unfortunately our ordinary scholars do not consult this well known fact already written in the book of Fiqh which are taught in their madaris.
