In the case of Zihaar, calling one’s wife one’s mother or mother-like with an intention to sever the physical relation with wife without divorcing her, the husband is obliged to set free a slave, if he can’t, then keep sixty fasts consecutively, if he can’t then feed sixty needy before touching his wife.
If the case is similar, the husband has to pay this atonement. Otherwise he may impose some penalty upon himself.
