    it is mentioned in the حجه الله البالغه جلد اول صفحه 379 where he says, that ” Abu Bakr asked the people in the mosque about the inheritance of Jeddah. Which one of you heard from the Messenger of Allah about the inheritance of Jeddah? Mughirah bin Shu’bah said: I did. He said: What did he say? He said: He gave him one-sixth? Abu Bakr said: Is there anyone else besides you? Muhammad bin Muslimah said: He is telling the truth. Abu Bakr gave him one-sixth. The story of Umar’s questioning of the people about the blood money (the blood money for abortion), then his reference to the news of Mughirah, and his questioning of them about the plague, and his reference to the news of Abdur Rahman bin Awf, and also his reference in the story of Majusi to the news of Abdur Rahman bin Awf, and the joy of Abdullah bin Mas’ud at the news of Ma’qal bin Yasar when he agreed with his opinion. The story of Abu Musa returning from Umar’s door, then Umar asking him about the hadith and testimony of Abu Sa’id for him, and similar matters are well-known and are narrated in the Sahihs and Sunan.”

    is it not representing that Hazrat Umer RTA was taking hukm from Hadith as hearing it from Sahabi ? While Sir Ghamidi says that we cannot take Hukm from Ahadith (Ahad Khabar)?

    please Explain it

    Ghamidi saheb accepts hadith when it complies with the Qur’an. He says that Hadith is not an independent source of Deen. It contains the explanation and applications of Deen.

    The where Quran Says about the mentioned inheritance issue, and if it is in Quran do we suppose that Umer RTA was not aware of that part of Quran?

    Thanks for the reply but it would be better if you explain it while Hazrat Umer RTA was asking from Sahabi it means that it was not in Quran that is why he asked the sahabi’s, How do you elaborate His stance on the Issue, wasnt Hazrat Umer aware of the Quran or he toke the Hukum from Hadith? explain it please in the view of Sir Ghamidi

    The share of the grandmother is not mentioned in the Quran, but it can be deduced from the Quran. The companions, when they had a precedent from the prophet, it made things for them easy and authentic. The same is the practice we find in courts. First, they look for a precedent; when they do not find it, then they interpret a law.

    However, academically, we establish a relation between the practice of the Prophet and the Quran. This academic approach is well established later by the Usuliyeen. The companions did not have to establish this relation every time. They just followed whatever they receive from the prophet. Yet, they sometimes try to understand the nature of this practice, whether it is based on the Quran or a part of Sharia or not, etc.
