Priracy In Islam
As this post is long I hope you guys read it throughly as I want to list all of the views i find. Please read them all and while considering them please answer accordingly.
Question:
My thoughts are that yes Piracy is stealing but is using a pirated copy same as making something pirated. By using it is like promoting it. If after this Ask Ghamidi considers it a sin Is it a major or minor sin?

In conclusion, piracy is impermissible in Islam. However, we also acknowledge the fact that downloading a pirated copy of the software is not the same as piracy. The person downloading the software has nothing to do with the Principle(The person who actually commits the crime) in creating a duplicate of the original software, he is not taking part in the public distribution of the pirated software and neither is his intention to make money out of it. However, as the person downloading the software knows of the copyright infringement and yet downloads the software, he becomes an accessory by helping or encouraging the criminal in some way. Therefore, knowingly downloading pirated items from the internet will be disliked.

If i were to explain it,when i steal from a store like a bag of chips the store just lost money but lets say i want to but a new video games if i buy it the companie is gonna gain 60 dollars but if i decide not to buy it the company stays the same.now with pirating its the same concept if i pirate it or decide not to buy it both times company will stay the same only difference being in 1 i get the game and other i dont either way company gets less success but again it doesnt do any damage to them.
Think other things like courses if i want to learn to cook and some persons selling a 60 dollar course on it but i find someone online who took the course and just send me all the info the course had for free is it considered stealing

The Council of the Islamic Fiqh Academy, in its Fifth session in Kuwait in 1405 AH. issued the following statement regarding copyrights:
“After reviewing the research papers presented by the Members and experts concerning “incorporeal rights” and after listening to the discussions on the subject, the Council RESOLVES:· First: Business name, corporate name, trademark, literary production, invention or discovery, are rights belonging to their holders and have, in contemporary times, a financial value which can be traded. These rights are recognized by the Sharee’ah and should not be infringed upon.· Second: It is permitted to sell a business name, corporate name, or trademark for a price in the absence of any fraud, swindling or forgery since it has become a financial right.· Third: Copyrights and patent rights are protected by the Sharee’ah. Their holders are entitled to freely dispose of them. These rights should not be violated. Allaah knows best.”
