Zina Laws Arent Making Sense To Me

Q1a — For example, there are two people who do zina. Both repent privately. However one isnt discovered publicly and neither does he confess so he doesnt get the punishment of lashes. The other person is caught and gets the punishment. So how is it fair? Either both who committ this sin should confess and take the punishment as atonement, or if repentance is sufficient for Allah to forgive then neither should be given legal punishment if caught. Please explain.
Q1b —- if zina is proven, they are subject to punishment of lashes, and then the person cant marry a believer. What if they have repented – do they still dont get to marry a believer? Why not? Also in comparison the person whose zina is not caught and as a result they did not get punishment of lashes , they could marry a believer, just after repentance, either a chaste virgin or someone chaste through repentance like themselves. How is this justice that two people do exact same sin but get different options of marriage partners simply because one was lucky not to get caught?
