    Assalam o Alaikum wa Rahmatullah,I pray this message finds you in the best of health and Imaan.
    I am writing on behalf of my sister, seeking your guidance on a sensitive matter involving her marriage and family situation.
    She has been married for 10 years and is the mother of three children. Unfortunately, the relationship between her and her husband has been troubled from the beginning.
    Approximately five years ago, her husband said the words: “Mein tumhein talaaq deta hoon.” After this, they reconciled and resumed living together. However, throughout the years since then, he has repeatedly said statements such as: “Meri taraf se tum farigh ho.”
    Recently, during an argument with my other sister, he clearly and loudly stated that ” ek tallaq mein phele de chuka hn..aur meri tarf se tallaq hai, meri tarf se tallaq hai” while my sister (his wife) and I were outside the room. This was clearly heard by his wife, myself, my elder sister, and the others present in the room.

    Can you please also look into the point that his wife was outside the room and He didn’t knew that she is outside and listening to his words.

    Given these events, we humbly seek your guidance on the following:
    Does this constitute a final (permanent) divorce (Talaaq-e-Mughallazah)?
    Is remarriage between the spouses possible under any circumstance, and would Halala be required?
    What is the correct duration and procedure of the ‘Iddat in this case?
    What obligations or restrictions should my sister observe during ‘Iddat?
    What is the Islamic ruling regarding the custody of their three sons, considering their ages (all are under 10) and best interests?
    We would deeply appreciate your detailed response (preferably a signed fatwa) in light of the Qur’an and Sunnah, and any guidance you can provide during this difficult time.
