    Assalamualaikum,

    I want clarity on a topic; My grandfather (late) started a business in 1980s, it was really small and wasn’t scaled up until my father joined in. My father took control of the business in 1990, up until then the busines was never progressing and my grandfather was only able to manage day-to-day expenses of the family, but my father really worked hard along with one of his brothers in the 90s period. My father are six brothers and two sisters, him being the eldest. During late 90s, one of his brothers cut himself off from the business and the family. After year 2000, the other 3 brothers joined the business, my father remained the leader of the company for almost 35 years until 2023.

    The community around us is also witness to the fact that my father was the one who worked most hard for the business from start to the present. Now, a time has come when the division of the company’s wealth and everything has become imminent for us, and the brothers say the division would be done equally for all the brothers even for the one who had left the family and business almsot 30 years ago.

    I want to know according to Islam, does it have to be this way that the wealth should be divided equally among all brothers irrespective of the their efforts or my father deserves more share of wealth?

    I await your kind response at earliest as my father and our family is falling into depression due to this treatment.

    NOTE: My grandfather died in the year 2019 and no deed of inheritance or wealth of any sorts was ever issued by him.

    The matter has a legal and a moral or ethical aspect. As a legal matter, the property is to be divided equally among the sons of your grandfather, considering they have no sister.

    However, as morality demands that the brothers should consider the greater contribution of your father in the business and if they agree they may allocate a bigger portion of inheritance to him. Moreover, your father should show generosity by not claiming a bigger share to avoid any conflict. This would be his virtue.
