I am considering emigrating to another country and taking citizenship of another country, but I see that some scholars say it is permissible and others say it is forbidden to take citizenship of a non-Muslim country. So is it shirk to take citizenship of a non-Muslim country because by doing so you are pledging allegiance to a secular constitution, and that does not go against Islam, as you are agreeing to something secular, which basically does not mean agreeing to a system that goes against Sharia law? And is it also haram because it means pledging allegiance to a non-Muslim ruler, even though one is only allowed to pledge allegiance to a Muslim ruler? I have heard that it is halal or haram to live in a non-Muslim country and to accept the citizenship of a non-Muslim country. you basically say this “You basically say this: ‘I swear/promise allegiance to the King and obedience to the Constitution and the laws of Spain.’”

The primary principle that Allah سبحانه وتعالى wants us to understand is that if a person is prevented from practicing their religion in a country, and the option to migrate exists, then migration is permissible and even recommended.

Beyond this fundamental principle, living in any particular country is largely a matter of personal choice. That choice is influenced by many factors, such as economic opportunities, law and order, personal safety, climate, culture, and family considerations. Therefore, no single location can be universally declared obligatory or forbidden for all people.

For example, a person may choose to live in Spain. If they later find that they are being persecuted or restricted in practicing their religion, they are permitted to migrate elsewhere. At the same time, living in a Muslim-majority country does not automatically guarantee ease or safety, as one may face other challenges, such as pressure to participate in political conflicts or wars.

Thus, the guiding principle is the ability to practice one’s faith freely and safely, while the choice of residence remains a personal and contextual decision, not an absolute religious mandate.

my personal understanding from listening scholar & I may be wrong in understanding it correctly.

yes ik but im not asking if its permissible to live in the non-muslim country or not, im asking is it permissible to get a non-muslim countries citizenship if you are saying the citizenship oath like if u have to pledge allegiance to a country or a constitution or a non-muslim ruler or if u need to have democratic values or if u need to support this etc

I don’t see any issues with it. Muslims are born every part of the world including non Muslim countries automatically making them obliged to the democratic constitution/ruler/monarchy. If someone voluntarily goes to a non Muslim country follow for better future opportunities & also get absolute freedom to practice his/her religion then why not. Again it’s my personal opinion.

the problem is the oath, does this count as giving bay’ah to a non-muslim ruler because giving bay’ah should only be to a muslim ruler and also because you would be pledging allegiance to a secular and democratic constitution which secular and democracy i heard dont go with islam as you can’t give bay’ah to a non-muslim ruler so the problem is the oath
