Question About Islamic Inheritance When Father Is Alive
Salam, there’s a question about Islamic inheritance.
If father is still alive, but very ill and mentally not stable. He cannot understand things properly as he had been ill from a year, and now he cannot hear or see as well. He is also in a state of confusion, the reality is mixed.
The family wants to distribute his money (about 9.5 million PKR) according to Islamic rules while he is still alive, because they think it may be difficult later.
The mother says that the father may have said in the past to distribute the money, but are not sure. Right now, he is not in a condition to make decisions. The mother is currently managing everything.
The family plans:
-
To keep some money (about 2 million PKR) for father’s treatment and mother’s needs
-
To set aside money for marriages (about 1 million PKR each for two youngest sons)
-
Then distribute the remaining amount among 4 brothers and 2 sisters
Questions are:
-
Is it permissible in Islam to distribute the father’s wealth while he is still alive in this condition?
-
If yes, how should it be done correctly?
-
If not, what is the correct Islamic way to handle this situation?
Please guide according to Shariah.
JazakAllah Khair.
