If we pray for our deceased parents who were righteous or if we do hajj for them because they really wanted to but couldn’t is it fair that they get good deeds for it?

Because a Muslim in a non Muslim family- if his children aren’t Muslim and he was in the same situation (wanted to do hajj but couldn’t) he wouldn’t get any rewards?

Do is hajj e badal actually legitimate? Shouldn’t it be base sourest on the intention fo the deceased rather than an actual practical implementation of the sincerity they had?

It is indeed based on the intention of the deceased and He will surely get reward for that, however, the execution helps the children psychologically in executing that intention of their deceased parents. That is why, it is neither obligatory nor forced on the children to do it at all costs, but the ones who want to achieve this satisfaction are not stopped from executing this.
