    And [even for the welfare of the orphans], you shall not wed idolatrous women32, unless they embrace faith. And [remember] a believing slave-girl is better than an idolatrous woman, although you may fancy her. Nor shall you wed your women to the Idolaters, unless they embrace faith. And [remember] a believing slave is better than an Idolater, although you may fancy him.33 These [idolatrous people] call you to the Fire; but God calls you, by His grace, to Paradise and to forgiveness34. And explains His verses to people so that they may take heed. (221)
    In this ayah the responsibility if getting women married is given to men. Can the concept of needing a wali for nikah be extracted from this? Or is it just descriptive of the time?

    I think it has to do with language.

    Also, see this verse:

    وَإِذَا طَلَّقْتُمْ النِّسَاءَ فَبَلَغْنَ أَجَلَهُنَّ فَلَا تَعْضُلُوهُنَّ أَنْ يَنكِحْنَ أَزْوَاجَهُنَّ إِذَاتَرَاضَوْا بَيْنَهُمْ بِالْمَعْرُوفِ ذَلِكَ يُوعَظُ بِهِ مَنْ كَانَ مِنْكُمْ يُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ ذَلِكُمْ أَزْكَى لَكُمْ وَأَطْهَرُ وَاللَّهُ يَعْلَمُ وَأَنْتُمْ لَا تَعْلَمُونَ(2:232)

    “And when you have divorced your wives and they have reached the end of their waiting period, do not prevent them from marrying their future husbands if they have come to an agreement according to the norms [of decency]. These words of advice are given to every one of you who believes in Allah and the Last Day; this is more decent for you and more chaste. And [in reality] Allah knows, but you do not”. (2:232)

      Yes that’s why I brought it up- the responsibility according to the language used is upon the males of the house to not allow their women- or not marry of their women to polytheist men.

      Is this descriptive or prescriptive?
