    غامدی صاحب سے سُنت کے ریکارد کو تلاش کرنے کا پوچھا جاۓ تو فرماتے ہیں کہ یہ (مسلمانوں کے عمل کے علاوہ) فُقہا کی کتب میں بھی درج ہےاور مُکمل اتفاق کے ساتھ موجود ہے۔ مگر جب بات ذبیحہ پر تسمیہ کی آتی ہے تو اُنہی فقہا میں سے ایک جلیل القدر فقہی امام شافعی قطعی طور پر واضع فرماتے ہیں کہ تسمیہ محض آداب میں سے ہے اور اس کی غیر موجودگی ذبیحہ کو حرام نہیں قرار دیتی۔ اس کے باوجود غامدی صاحب ذبیحہ پر تسمیہ کو نہ صرف سُنت کی فہرست میں شامل کرتے ہیں بلکہ اُس کو حلت و حرمت کی شرائط میں بھی شامل کرتے ہیں۔ اس امر کی وضاحت درکار ہےکہ جس ریکارڈ کو بُنیاد بنا کر سُنت کی فہرست مرتب کی گئ ہے اس ریکارڈ میں تو تسمیہ کی شرط موجود نہیں ہے تو کیا یہ سنت کی فہرست میں محض اضافہ نہیں کہلاۓ گا؟

    Surah al-An’aam 6:121 says “And do not eat of that upon which the name of Allah has not been mentioned, for indeed, it is grave disobedience.” Sahih international
    Its a direct evidence that we have been advised to take Allah name.

      Thanks for that but Ghamidi shb has put this in the list of Sunnah and that is the basis of my question and argument here.

      There’s a different discussion on that Ayat and it’s implications hence, I’d refrain from that, for the moment being.

    Fiqh is not the basis of sunnah. The basis of sunnah is Ijma and tawatur which is found within the practice of the ummah. When we find something that the ummah is practicing today, we go back in history to find evidences for any breaks, major agreements/disagreements, or traces of initiation of the practice anew. Books of fiqh help us trace these evidences because in addition to jurisprudence, they also relate to us historical practices of the ummah. In that capacity, these books help us in finding any corruptions or innovations that might have entered into our religion; they don’t serve as the basis for sunnah.

    As far as tasmiyah is concerned, imam Shafi’i does not negate the practice. According to him, if someone doesn’t do tasmiyah at the time of slaughtering, the meat is still considered permissible. In effect, he confirmed that the practice of tasmiyah at the time of slaughtering was found in the ummah at his time. Ghamidi sahab’s view, in contrast, is that tasmiyah at the time of slaughtering is required. This difference of opinion has no bearing on the ijma and tawatur of the practice itself. It has to do with it’s application.
