    Dear sir,

A friend of mine is facing terrible martial life in which his wife is continuously abusing him and his family from very beginning.

Situation became more worst after she gave birth to a baby girl.

Then her parents, (my friend’s inlaw) took her to a psychiatrist then to a psychologist for her treatment but things are getting worst for him day by day

Initially he never thought of a divorce as it is the most unliked halal act infront of Allah,

But now he’s getting annoyed day by day.

They’ve been married for nearly 5years. For him a divorce is never his priority, but now he’s stuck Ina toxic relation.and what he cares is just of his daughter that law will enforce custody of daughter in favour of her mother although she is depressed patient.

    Kindly do give a reply.

The room for divorce is open for both the parties (husband and wife) due to any reason that may arise in the future. There’s no set of conditions which, if fullfilled, makes giving of a divorce a permissible act. However, there are certain requisites of divorce which need to be followed when one decides to give divorce. A husband can give divorce while a wife can ask for a divorce from husband, which he is bound to give if wife demands it in an absolute way. And if the court can be convinced regarding mental health of the mother which may affect upbringing or well being of the child, then court may give custody of the child to the father. Following is the Islamic Sharia regarding divorce:
