    Is it mandatory for a woman to get the permission from the Wali “Mostly father” in order to perform Nikkah?

    And also what’s the adolensce age of the man and woman in Islam?

    The difficult question remains that at what age a person is considered adult to make his own decision to go through a Nikah without parent’s consent to be considered married in Islam.

      Assalamoalaikum Brother Nadeem,

      Islamically a person needs to be adult and definition of adult for a girl is that she has gone through menstruation as you know, other than that age is not considered a constraint.

      Another point to note is that Imam Abu Hanifa is the only one Imam who allows Nikah without Wali out of four Imams.

      Thank you Brother Fahad for great information. May I say, do you think maturity in Islam may be based on mental and physical maturity not just physical?

      Dont you think perhaps standard of maturity would be the same throughout in all situations as it is for Orphans for which a mental test is required to determine maturity before a fiduciary returns their assets?

      Because if you just consider physical maturity, the maturity age may be from 9 to 12 years; which seems too young.

    Assalamoalaikum Brother,

    With Physical, mental maturity can also be considered along all other factors which will vary from person to person. Perhaps this is where a guardians presence in decision making becomes really important.

    You can also read and understand Ustaz Ameen Ahsan Islahi RA and Ustaz Javaid Ahmad ghamidi RA tafseer on Surah At-Talaq ayat number 4. It is also worth checking other Ulema and 4 Imams commentary on this Ayat.
