  • Right To Inheritance Of A Deceased Child (Grandchildren)

    Assalamualaikum

I’ve been told that a deceased son /daughter of a person can’t be a legal heir of assets from his father and so decendents of that person can’t claim their wiraasat from their grand parents.

    The ruling seems unfair

I would request for a detailed opinion from your end alongwith refrences from qurran and sunnah.

    Regards

The heirs of an already deceased son or daughter do not have any share in inheritance according to the sharia. However, the person who’s inheritance is being distributed can give something to them in his/her will. Similarly, those who receive their shares in inheritance can give something to the heirs of the deceased son or daughter if they choose to do so.
