Talaq E Biddat
In India recently the supreme court banned talaq e biddat ( three talaqs at one sitting) and a law was made that awards the husband a 3 year prison sentence for doing so. Does a marriage get nullified if talaq e biddat is adopted according to the Shariah law? Since talaq e biddat is banned the court has ruled that such a divorce is unacceptable so the marriage remains, but according to most scholars the marriage is nullified with the third statement. The Indian law forces the husband and wife ( now divorced) to stay in a live in relation and any sexual relationship outside marriage is zina, will the husband and wife be guilty of living outside wedlock? Does a woman have to observe iddat everytime her husband divorces her or only after three talaqs does iddat start? If a woman marries a man to keep her parents wish but doesn’t like him/ is not happy with him can she seek a khula if her husband is reluctant to divorce her? Why is three talaqs in three months not the right procedure, the Qur’an doesn’t mention the way Ghamidi Sahab has understood the law, why is there such a misunderstanding even among qualified scholars? What should one do if the kazi accepts a talaq given in the wrong method, will the marriage remain even if the kazi has mistakenly accepted the talaq?I hearc that a clause be added in the marriage contract from the end of a bride as a prenuptial aggreement wherein she can divorce her husband, what are the conditions for this type of a divorce?
