Tallaq Given Under Pressure From Parents
Jan Sher, son of my friend. Divorced his wife under extensive pressure of his parents 2. Years ago.
Completed all papers till union council also. Now realises his mistake and wants her back home.
1- Is there a chance without Hallalah ?
2- Does this require new Nikkah new Mehr ?
3- How can he get a formal FATAWA for his future reference.

triple divorce has no foundation in Shariah. Quran explicitly tells that men can divorce their wives two times in a marriage bond, if they reconcile every time after divorce and the last divorce will be final, no reconciliation is possible until the woman marry someone else and got divorce from there too or the second husband die. imposition of triple divorce at once was an executive order of Umar bin Khattab as a caliph, not a shariah law.
but unfortunately, the practice in our countries is to give triple divorce. even the paper work mentions triple divorce, which is not necessary at all.
If you take our opinion, we can tell that if it happened for the first time, you can marry her without Halala, with a new Nikah. But how would you get your legal paper done, you should consult a lawyer.

Assalam o Alaikum @Irfan76 3 talaq ak sath dene ka tasavvur kab peda hua ahl e arab mein or wo kio ak sath 3 talaq dete thi jis ki buniad per bad mein unhe pocha jata tha ke niat kia thi or aj k dor me 3 talaq ki koi hesiat nahi he to wo ak haram kam kse hua or agar haram kam he to uski wajood se kse inkar kre ge suppose halala haram he mgar islami shariat ka mazak bnate hue nika kia jata he magar wo nika b bakaida hesiat rakhta usi tara 3 talaq dena agar haram sai apne wajood me koi hesiat rakhti he b ya nahi agar nahi rakhi pir wo haram kse or iska agarz kaha se hua or kio kr hua jab ak talaq bhi mukammal talaq he pir 3 ki zaroorat kio pesh ane lagi ak sath i am still.confuse so plz help me to clearify my mind thank u

حرام کا لفظ ان احوال پر کہنا تکنیکی اعتبار سے درست نہیں۔ یہ قانونی حیلے ہیں جو کسی بھی قانون کے ساتھ کیے جا سکتے ہیں۔ اسی بنا اللہ نے فرمایا کہ اس کی آیات کو مذاق مت بناؤ۔
ایک بار میں تین طلاق کا استعمال کے واقعات رسول اللہ کے زمانے میں سامنے آنے لگے تھے جس پر رسول اللہ کے سخت اظہار ناراضی فرمایا تھا۔ ان تین کو لیکن تین نہیں مانا گیا تاہم عدالت ایسا کر سکتی ہے تو یہ حضور عمر کے زمانے میں ہوا ۔ لیکن یہ شرعی قانون نہیں تھا انتظامی حکم تھا۔ آج بھی عدالت اگر درست سمجھے تو تین کو تین نافذ کر سکتی ہے مگر شرعی حکم وہی رہے گا کہ ایک بار میں تین طلاق نہیں ہو جاتی۔
