Iddat Period After 3 Years Of Separation
My niece lived in England with her husband. They remained married for ten years until her husband declared him as atheist. They didn’t keep any marriage relationship for about three years. She applied for khula in Pakistan and will get the court permission after a month. She is currently in the US and found a good person to get married.
Can she do new nikah as per Islamic shariah by doing nikah at home and start living with new husband?
Legal nikah contact will be done later upon receipt of Khula certificate from the court.
Please explain in the guidance of Islamic shariah without considering law of the land.

As a principle, there is no ‘iddat‘ in the absence of marital relationship between a husband and a wife. Please see for details:

She is in the Nikah of her first husband, she cannot make her second Nikah. After divorce certificate she can marry another person.
