When continued violations of personal laws start resulting in oppression against other party’s rights at a societal level, then state does have a right to make law in that domain. Hazrat Umar (rta) himself, in the capacity of a ruler in consultation with the members of the shura, upon seeing that people had adopted a very careless attitude in this regard which is resulting in voilation of rights of the other party at a massive level, as a punishment, promulgated three divorce sentences as final.
