Assalam o alikum sir.Me and my husband have been married for over three years now. Currently, the predicament is that we have been trying to have a family of our own but due to a medical condition (fertility issues) in one of us we are unable to proceed. We have tried all medicines and medical procedures as well but all in vain. My husband’s sister and brother in law are willing to help us through surrogacy where i would be the surrogate mother of their child and after the birth of the child, we would legally adopt the child with their consent. Just wanted to know if we are breaching any boundaries that Islam has set in our scenario. Please guide. Thanks

Can I keep surrogate child with me? And do I have to tell him who his real parents are as In my case my sister in law and her husband are willingly giving us their zygote?

Surrogacy is allowed, but to hand over one’s child to someone else, without having an excuse for the inability to bring him or her up, is unethical on the part of parents. The child is not a property to give to others. It is the basic right of the child to receive an upbringing from his real parents unless they are or become unable to do so. Even in the cases of valid adaptation, it is compulsory to name the child after his father and the reality must not be hidden from the child.

If such an arrangement you can make that the child may be brought up in your lap but may not be deprived of the attention and affection of his or her real parents, too, then, the ethical question finds less room to object to.
