    Assalam o Alaikum

    My father died in 2007 he had a wife, eight sons and four daughters.

    During his life he distributed his wealth as follows.

    1 – He gave his business to three sons who were helping my father in his business. (As per government record three sons now have the legal title of that business)

    2 – He made a registered gift deed of his House in favor of seven sons.(As per government record seven sons now have the legal title of that house)

    He didn’t give anything to his wife, his four daughters and one son.

    He was not displeased with his wife and daughters, though he was displeased with his one eldest son (who wasn’t given any thing from my father)

    Now, one of our brother saying that we should sell the house and distribute the sale proceed to all family members as per Islamic law of inheritance but other brothers are not agree.

    My questions are

    1 – Does Islam give right to a person to distribute his wealth according to his wishes during his life or not?

    2 – Did my father do an Haram Act by distributing his wealth as mentioned above.

    3 – Are those brothers who are not agree to distribute according to Islamic law of inheritance are doing Haram act and will be questioned at judgement day?

    The person has the authority to distribute his wealth or estate to whomever he likes during his life and even after his death through his will. There is no responsibility on the recipients of the property, rather they are not entitled to redistribute the wealth or estate according to the Shariah law of inheritance. The law of inheritance comes to play only when there is property after the debt is paid, and the will is made.

    Any element of justice or injustice in this regard is the matter between the person and his God. If there was any injustice, the children should request their father to correct it before his death. Now, what is done, is done. All the recipients are the legal heirs of the property. However, if someone likes to share his or her or their share with the deprived one, they can do that on their own.
