    Married for 30 plus years. Children grown up. If a wife feels that the marriage is not salvageable despite thirty years of trying, due to major personality and opinion differences, if she files for divorce in the US ( couple had a Nikah in Pakistan and then a civil marriage in the US), should she still expect that her assets are her own per Islamic doctrine. She worked for the last 23 years alongside her husband. Also felt she took the burden of most family and children’s upbringing needs in addition to working. Is it ok to follow Islamic law of assets distribution during divorce or should she be subject to US law ( meaning what she brought to the marriage through her job and savings, her retirement fund should be hers vs being shared with her husband upon divorce). Thank you.

    Unless there is a mutual understanding on the division of assets between the husband and the wife, the court generally decides how the assets shall be distributed. I don’t think that either party has any option in this regard. You should consult a good divorce lawyer and they should be able to help you better according to the specifics of your situation.
