    As-salāmu ʿalaykum – ٱلسَّلَامُ عَلَيْكُمْ

    I am writing Will and my mum is eligible for one over sixth share (my dad has passed away; I have 4 children and a wife; we live in UK but my mum lives in Pakistan).

    However my mum is quite old, has advanced dementia and has lost her capacity to deal with financial issues.

    What shall I do about my mum when I write my Will?

    As I said before, we plan to distribute estate on the death of second spouse.

    The legal advisor in the UK is saying that I need to keep my mum out of the WILL due to legal issues involving the transfer and distribution of estate as I live in UK but my mum lives in Pakistan.

    I am sorry to have such a complicated question but I very much hope for some guidance from Sheikh Ghamdi Sahib.

    Please advise.

    You have the authority to appoint any share or no share for any of your heirs. The law of inheritance comes into play when there is no will. All that is required in making a will is to make it with justice and sincerity.

    If your mother is that old, you can allocate a monthly stipend for her or any other arrangement you deem right to make for her. There is no restriction from Shariah.
