  • Condition On Contract

Posted by Muhammad Rohaan Tahir on March 17, 2024 at 11:36 pm

If i say to someone that i want to do business with you in future and give me some discount or concession on the current product or the deal.

Is it like condition other than the contract and is it invalid?

    I read

The Prophet (SW) prohibits the combination of two contracts in a single agreement. As reported in many sources, the Prophet (SW) prohibited two sales in one sale (bay’atan fi bay’ah) and two agreements in one agreement (safqatan fi safqah). Also, he prohibited the combination of sale and loan contracts (bay’ wa salaf) in a single arrangement.

I want your guidance in this regards.

The principle in business is that it should not entail anything unethical. There should be no intention or effort to deceive or harm someone.

After the contract both the parties have to agree on anything which is not mentioned in the contract.

In your case it is asking a favour and therefore no objections can be raised.

Sir does asking the favour is considered as riba as one or both parties getting benefits other than the main contract.

Like i am asking please reduce the price so i will become your regular customer and we will work together in future again.so availing discount on the current contract.

In this case one party get the lower price and the other party get a regular customer.

Is it benefiting other than the current contract?

Is it invalid according to Islamic rulings?

Riba is only in the matter of loan. Asking for a favour even in loan is kir riba. It is the compulsion to pay more than the actual amount makes it riba.

So asking a favor in normal contract is not considered as riba?

As i explained in my previous question?
