    Assalamu Alaikum, hope you all are well. I have a question to ask for someone. What if Mr X does not know who he hit him (Mr. Y) by mistake (while saving his own life on the road from 2 people who were chasing him for his car or to hurt him), Mr. Y gets struck with the side of his car on the round about while Mr. X was escaping from potential trouble.

    Now Mr. X wants to pay for this unintentional sin, what will be the procedure?:

    a) he does not know whether Mr. Y was hurt or not, whether died or not. he know nothing and cannot be sure about it today. What will be the process of repentance? Diyat kese di jaygi is ki..

    b) Will he actually be accountable? because neither he wanted to hurt anyone, instead he wanted to save himself.

    c) in the best possible case to be forgiven in the hereafter without any trouble, what should Mr. X do?

    1 More thing, if Diyat deni he hogi, to who should Mr. X give it to? Because now going back to find that person/his family seems impossible after years. What can be best done here to prevent from Akhirat Accountability? Also, it cannot be sure know whether he was injured or not, or was dead.

    Also, how one should determine if the person who got hit was even injured or not, or what happened to him is unknown for a reason that the driver was saving his life from the people who were chasing him, so he could not stop. how should he determine the diyat and who should he give it now?

    Diyat is given when the case is settled by the court.

    It is easy to investigate nowadays what happened on a date, in that place. The police would have had the record if anything serious happened.

    If nothing is known, it means nothing serious happened. In that case one may ask for forgiveness from God.

    one thing that is to add is: if that person says he had an active learners driving license, but no body with a proper driving license was accompanying him, and there seem to be a law that a driver should accompany a learner driver. however, not sure in 2016, having a learning driving license in Karachi was sufficient or not. he usually drove to office, university or shopping etc., with a learning driving license.

    keeping in mind the above, now this person wants to know what penalties or sins he have on him and should he go to any police station or a judge to put himself in the jail time.

    as the situation was (repeating), 2 guys on a motorbike started hand gestures and started stopping him like they seemed snatchers but not sure. they were constantly doing it and that the driver felt the need to not pay attention to them. This person driving car got afriad (acted due to duress) or in fear he tried to get away from them but they persisted chasing. and then on a roundabout (as he was clear that he can take his car out in speed, he sped on the roundabout and on the side door he felt (maybe the young person was trying to catch a bus or something) he hit on the side door where there is a mirror), and he saw it from the rear mirror that people gathering but he had to move on as those 2 started chasing again on bike. and then after this whole 15 min chase (very tension moment, he got stones on his car, broken side mirror by those chasers etc) the driver finally faced a stopped traffic on a signal. at that point where there was a stopped traffic, he had to somehow start the car again out of extreme fear… he hit some cars on the side, and hit one more person (head injury), and then he hit himself in the truck. People gathered, police came, he then got out of his car and shouted to arrest these 2 men as well and said inko bhi pakro ye mere pichy pary thy, and those 2 left on the bike right away. NO ONE came whose car were hit from this person, but the one with head injury, he also come to the local police station.

    This driver’s father and brother came, and police firstly thought the driver was drunk and didn’t believe in the story, but then they agreed that this person not seems like taking any drugs, he seems very clean. this head injury man was sitting with him, and this driver told him that he was majboor and me kia karta me bohot dara hua tha.. his father came, took this head injury man to the clinic nearby, got him treated and the doc said its just a minor thing. that person insisted money but his father handled the situation. Even by asking his brother (the driver’s), who came with the father, said that this man was alright. But even in 2024, this driver still feel grieve for him as well.

    now in this whole situation, this person is thinking about the one person who got hit with the side of the car (the roundabout), whether he was dead, or injured or nothing happened because he didn’t stop. but with him being on the wrong side (Having only a learning driving license, albiet he is a fine driver), what should he do in terms of law and islam.

    now, in the year 2024, his mother is dependent on him. and parents are searching marriage proposals for him.. what should be the thing he should do at this point.:

    – Should he put himself in the jail somehow and get done with punishments leaving all the current things aside?

    – should he wait and go to muftis and lawyers and seek fatwa on this case.

    – Or, should he try to find about that person only who he hit on the roundabout and until he finds about him, he should move on his life for now?

    and lastly, what if he got married, and later some suggested that iski kuch saza ya diyat ya jail time milna chahye hai, then will he be doing wrong to his wife?

    This driver want to resolve this sin/issue in this world. What should he do. If possible, please provide a detailed answer. may ALLAH reward you for this.

    Islam does not require imprisonment. Instead, the payment of Diyat is necessary. If the injured person or their relatives (in case of death) choose to forgive the Diyat, then there is no further obligation, and there is no need for concern. If the injured person cannot be located, the individual may let go of the matter, as it was not intentional.
