    My mother has passed away and she inherited a house. We are five siblings. One of our brothers has passed away. He left a widow and has a son and a daughter. After the death of our mother, the upper portion of the house was built for the widow to live separately, in which the widow also invested 19 lakhs. We are all willing to pay the widow the money she invested which is 19 lakhs. But the widow’s uncle demands that along with Rs.19 lakh, the profit on it should also be given to her separately, which if kept in the bank, is calculated according to the rate of profit or interest rate of the Mezan bank from the time the house is built till its sale.

    My question is whether this demand of maternal uncle is permissible in terms of law, inheritance or not?

    This is not about inheritance but giving her, the money she spent back to her. Her share in the inheritance will calculates in addition to her investment.

    One should do it with justice. She should be paid back according to the current value of the upper portion against her share, that is, Rs.190,00,00. Her uncle’s suggestion is one the suggestions to give benefit of time. In such cases an impartial arbitrator should decide between the two parties.
