  • A Question About Illat And Command

    Aasallaam u alaikum,

My question is that, in the commands of prohibition of something, there is an illat, which as long as it’s found in that thing or something else it remains Haram. And when the illat is removed the thing is no longer there.

I want to present a case of alcohol and the drunkenness. If from wine, someone adds a compound which makes such changes inside the wine drink that it no longer causes drunkenness, so that drink becomes halal. So in the same way, for example. A person for example clinically diagnosed and ascertained that he does not posses the enzyme or the absorbing compounds in his body. As a result, the ordinary wine that makes other drunk has no effect on him whatsoever (there’s no clinical case like this, however I’m trying to know the principal and it’s corollary), will that wine be permissible for him? it should by the same token of illat

A general law cannot give excuses to individuals in such cases; otherwise, it becomes an excuse for further violations. The person may not be sinful in his individual capacity, but the law won’t allow him.

@Irfan76 sir he won’t be sinful in his individual capacity…

Does it mean that in islamic govt he will not be given any concession. (All the laws of tazeer punishment would also apply him). But for example such person doesn’t drink normally, but in one incident for example his glass of grape juice due to natural fermentation in fridge became alcoholic, now instead of wasting it, if he drinks it secretly (no one else would know about it), will it be okay for him to drink in this specific scenario?
