What Constitutes A Divorce And State's Authority
Sir where do we get the words of divorce from, like which hadis shows the use of words like ‘ i divorce you ‘? And if intent is the only thing required then where is that shown in the ahadis? And if the law is not against islam then the words like ‘ ineffective ‘ which show that divorce will not be effective infront of allah either as breaking law means going against allahs ahkam, so does the state have a right to create this? That means orally without union council no divorces take place?

It is clear from Quran that Divorce needs to be a conscious decision with complete intention. The way Quran described the procedure of divorce, this matter becomes clear. When state makes a procedural law in this regard then that law also needs to be followed. A muslim should abide by both the sharia law and the state law. The wordings of a divorce may vary from culture to culture but the concept of divorce is universal without any disagreement and people living in a society always know what words/actions etc. constitute a divorce.
