If Someone Borrows Money From You

If someone borrows money from you and is not able to pay you back because of his financial conditions.. should we take action against that person legally(will this count as jihad)or it is better to give him that money (will this count as charity) …on other scenario if person has money to pay you back but doesn’t pay you back because he think he is very powerful and you won’t be able to anything to him..what should we do in this scenario fight legally against that person(will this count as jihad)…or let it go(will this count as charity)…because you don’t want to get in troble.

In the second case, giving up on your money is not charity, but in the first case, it is charity if your let it go.

The rest is up to your discretion. You are allowed to adopt either of the ways.
