تو ثابت یہ ہوا کہ اگر غریب انسان سے غلطی ہو اور اس کے پاس دیت ادا کرنے کی رقم نہ تو وہ سزا کا حقدار ہی ہو گا۔ یہ کہاں کا انصاف ہوا؟

The condition for diyat applies when unintentional killing is proven.
Hence, it is up to the grieving party and state to decide whether to forgive the accused. The Quran provides both options: accepting diyat (compensation) or forgiving out of goodwill.
If the grieving party or state do not accept diyat, the accused will be punished according to the law.

i. Intentional: يَاأَيُّهَا الَّذِينَ آمَنُوا كُتِبَ عَلَيْكُمْ الْقِصَاصُ فِي الْقَتْلَى الْحُرُّ بِالْحُرِّ وَالْعَبْدُ بِالْعَبْدِ وَالْأُنثَى

If the matter is to be settled on Diyat, and the murderer is not able to pay it, the diyat will be paid from Bait ul Mal, from the public treasury.

سر سرکار کسی کی دیت کیسے ادا کر سکتی ہے جبکہ مقدمہ سرکار کی مدعیت میں ہی درج ہوتا ہے۔ یہ کیسے ثابت ہوا کہ دیت سرکار ادا کرے گی؟ کیا کوئی مثال سنت نبوی میں موجود ہے؟

رسول اللہ ﷺ کے دور میں دیت قاتل کا قبیلہ ادا کرتا تھا۔ یہی عرب کا رواج تھا۔ اسے عاقلہ کہتے تھے۔
دیت بیت المال سے بھی ادا کر دی جاتی تھی اس صورت میں جب قاتل رعایت کا مستحق ثابت ہو جاتا تھا۔
، قال: قال رسول الله صلى الله عليه وسلم:” انا وارث من لا وارث له اعقل عنه وارثه
ابن ماجہ 2634“.
رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”جس کا کوئی وارث نہ ہو اس کا وارث میں ہوں، اس کی طرف سے دیت بھی ادا کروں گا اور اس کا ترکہ بھی لوں گا

Diyat applies in two situations: accidental killing and in cases of intentional murder when the victim’s family chooses to accept diyat instead of pursuing Qisas.

Diyat applies only when the state decides either of the following first:
1) The killing was unintentional (Qatl-e-Khata). Or,
2) The killing was intentional (Qatl-e-Amad) and the murderer deserves some linency to be consiered for Diyat. Then the matter will be referred to the heirs of the victim to decide whether to opt for Diyat or not.
In Pakistan, Hanafi jurisprudence is followed which gives the right of Diyat directly to the heirs of the victim.
