    I would like to know more about the Islamic law of qusas, which is repeatedly abused in Pakistan. Any person in power can kill anyone at will, and forced the victim family to take some money and keep quiet. This has happened so many times in Pakistan. This makes the mockery of justice. We have serial killers, and rapist in the midst of the society, and if we just keep forgiving them after taking deet money. The crime will never come under control.

    Diyat only becomes applicable when both the state and the aggrieved party agree to it. If state reaches a conclusion that crime be punished through Qisas, then no Diyat will come into play. However, once the state decides that Criminal deserves some liniency through Diyat, they will refer the matter to the victim’s heir. It is only after the victim’s heir agree to diyat, diyat will be applied. If they don’t agree to Diyat, the case will revert back to Qisas application. Unfortunatley, this is not accepted in Hanafi Fiqh, they refer the whole matter of Qisas and Diyat to the victim’s heris.

    This is a general rule I know. But no explanation how to implement it during modern time, due to abuse of the law.

      Perhaps it is very simple. If someone comes to court the second time for a similar crime, the only option available to the criminal is punishment and compensation to victims.
