  • Status Of Secret Nikkah With One Divorce And Violation During Iddah

Posted by Elsaa Noor on September 14, 2024 at 10:42 pm

After some months having secret nikkah (without intercourse) the wife require talaaq from husband (because he was already married with 3 children and he hides it), he give one talaaq to wife, the wife lives separately but after 2.5 months they met with each other (without any intention of rebonding but cant control nafs)in private place and goes physical but ( they had never intercourse) and after one day the 3rd menstrual cycle of wife has started.
(The wife dont want to be in relation with him, and he knows that we cannot live together, and now for clarity the wife require again talaaq he blackmail her that she had to do this or that thing. What should the wife do. Although no families are involved and its between them secretly)
The question is Are they divorced or still in nikkah?
Now the family of girl wants her to marry, but she is afraid whether it will be halal or not.

This marriage is considered invalid since it lacks the fundamental requirement of public declaration. The couple has the option to terminate this arrangement if they choose not to proceed. Furthermore, as no consummation occurred following the divorce, she is released from the Nikah and is eligible to marry someone else.

Does it mean the wife ia free from nikkah and she dont need any verbal approval from him. And she can marry to someone else.

Yes. She needs no approval from him.
