    Aoa. Suppose a father who only have one daughter passed away. His wife and parents are already dead (the daughter’s mother and paternal grandparents). The man has only one sibling i.e. a brother who has a two years old son. The brother (the daughter’s paternal uncle) is also dead. The daughter is 25 years old and her cousin is 2 years old.How the inheritance of that man will be shared? If his daughter gets half the share and the remaining half is inherited by his nephew, what is the logic behind it? If issue is that of guardianship then how can the male cousin look after the needs of his cousin? Isn’t it better in that case for the daughter to inherit all the wealth since she is of sound mind and age, have completed her education and is working so she can look after both herself and her cousin. Kindly guide on this matter. Jazak Allah

    Isn’t Shia fiqh regarding inheritance more logical and just?

    The deceased had the option to make a will nominating his daughter as the sole recipient of the undistributed inheritance. In the absence of such a will, the undistributed inheritance goes to the brothers and sisters of the deceased in 2:1, and in their absence, to the nearest male member of the family. However, the remaining amount can go to the daughter, if the authority/court finds it necessary or suitable.
