Interest Payer Is Counted As Soodi In Riba Al-Fadl Hadith
in the Hadith of Prophet puh where he says ” الذهب با الذهبب و الفضه باالفضه و البر وبالبر و الشعیر و بالشعبر و التمر و بالتمر و الملح وبالملح مثلا بمثلا ویدا بیدا فمن زاد او استزاد فقد اربی” at the end of this hadith the prophet says that both the one who pays more or the one takes more are counted as soodi and both is counted as riba while Sir Ghamidi says the first one is not sinner but the second who takes sood, could you please elaborate on this or did Sir Ghamidi elaborate it?

غامدی صاحب میزان میں لکھتے ہیں
مبادلۂ اشیا کی صورت میں ادھار کے معاملات میں بھی نبی صلی اللہ علیہ وسلم نے اِس کی ہر آلایش سے بچنے کی ہدایت فرمائی ہے ۔ آپ کا ارشاد ہے :
الذھب بالذھب وزنًا بوزن مثلاً بمثل، والفضۃ بالفضۃ وزنًا بوزن مثلاً بمثل، فمن زاد واستزاد فھو ربًا.(مسلم، رقم ۴۰۶۸)’’تم سونا ادھار دو تو اُس کے بدلے میں وہی سونا لو ، اُسی وزن اور اُسی قسم میں، اور چاندی ادھار دوتو اُس کے بدلے میں وہی چاندی لو ، اُسی وزن اور اُسی قسم میں، اِس لیے کہ جس نے زیادہ دیا اور زیادہ چاہا تو یہی سود ہے۔‘‘الورق بالذھب ربًا إلا ھاء وھاء، والبر بالبر ربًا إلا ھاء وھاء، والشعیر بالشعیر ربًا إلا ھاء وھاء والتمر بالتمر ربًا إلا ھاء وھاء. (مسلم، رقم ۴۰۵۹)
سونے کے بدلے میں چاندی ادھار دوگے تو اُس میں سود آ جائے گا۔ گندم کے بدلے میں دوسری قسم کی گندم ، جو کے بدلے میں دوسری قسم کے جو اور کھجور کے بدلے میں دوسری قسم کی کھجور میں بھی یہی صورت ہو گی۔ ہاں، البتہ یہ معاملہ نقدا نقد ہو تو کوئی حرج نہیں۔‘‘
اِن روایتوں کا صحیح مفہوم وہی ہے جو ہم نے اوپر اپنے ترجمہ میں واضح کر دیا ہے ۔ رسول اللہ صلی اللہ علیہ وسلم نے جو کچھ فرمایا ، وہ یہی تھا ۔ روایتیں اگر اِسی صورت میں رہتیں تو لوگ اِن کا یہ مدعا سمجھنے میں غلطی نہ کرتے ، لیکن بعض دوسرے طریقوں میں راویوں کے سوء فہم نے اِن میں سے دوسری روایت سے ’ھاء وھاء‘ کا مفہوم پہلی روایت میں ،اور پہلی روایت سے ’الذھب بالذھب‘ کے الفاظ دوسری روایت میں ’الورق بالذھب‘ کی جگہ داخل کر کے اِنھیں اِس طرح خلط ملط کر دیا ہے کہ اِن کا حکم اب لوگوں کے لیے ایک لاینحل معما ہے ۔ ہماری فقہ میں’ربٰو الفضل‘ کا مسئلہ اِسی غتربود کے نتیجے میں پیدا ہوا ہے ،ورنہ حقیقت وہی ہے جو رسول اللہ صلی اللہ علیہ وسلم نے اپنے اِس ارشاد میں واضح کر دی ہے کہ ’إنما الربٰوا في النسیئۃ‘ (سود صرف ادھار ہی کے معاملات میں ہوتاہے ) ۔

I appreciate your response but the word in your translation (جس نے زیادہ دیا) while, Ustad Ghamidi says that the one who pays more he is in need and he is Not Soodi or he is not to be punished he is Soodi. while the hadith count both the interest payer and receiver indulged in Riba which is گناه کبیر.

This is another debate. Ghamidi saheb translates the word Mukil as the agent who hunts and manage the clients, not the one who pays interest.

This particular Hadith is pointing towards an interest based transaction, not to the fact who is sinful and who is not. In an interest based transaction, one party pays interest and the other party receives interest. This is exactly this hadith is pointing i.e. who who pays more and the one who receives more are part of an interest based transaction and this particular transaction will create these two parties.
Regarding condemnation of the person who earns interest and the ones who facilitates him; the Hadith pointed out by Dr. Irfan Shahzad Sahab above is used where the word “Mukil” has been translated differently by Ghamidi Sahab and his arguments can be understood in the link below.
