Gifting Property To Children
As-salāmu ʿalaykum – ٱلسَّلَامُ عَلَيْكُمْ
I have two questions.
1.
I own two properties and want to gift these to four of my children (2 sons and 2 daughters) on equal basis now when I am alive.
My understanding is that I am allowed to give whatever I want to who ever I want in my life and this has nothing to do with my inheritance. While gifting I am also treating my children with fairness and justice and on equal basis.
Is my understanding ok from Shariah perspective?
2.
Imagine I make a written agreement with my children that I am gifting both of my properties to them on equal basis but for some legal reasons I am not able to transfer the ownership to them in my life.
After my death, will my children inherit these two properties according to my written agreement (each gets equal share irrespective of gender) or according to the shares prescribed by the holy Quran where my sons get double the share than their sisters?
