    I have a question: does a talaq (divorce) given without witnesses count as valid? I have heard a Pakistani scholar, Maulana Muhammad Ishaq Madni, who emphasized in several of his videos that a talaq without two witnesses does not count. I have also read that Muhammad Nasir al-Din al-Albani held a similar view. In Surah At-Talaq, it is also mentioned to bring witnesses for divorce and for taking the wife back. What is Javed Ahmad Ghamidi’s view on this issue? I respect Maulana Muhammad Ishaq Madni and I have heard and read a lot from him, but I would like to understand Ghamidi’s position on this matter.

    Witnesses are required at the end of the term (iddat) of divorce to resolve any dispute, not at the time of divorce. See verses 1-2 of Surah 65.

    But according to javed Ahmed ghamidi it say talaq without witness is unvalid

    He said the same thing that the witnesses and required to resolve a dispute. However, Their presence is not the prerequisite of divorce.

    But aren’t you also a student of Javed Ahmad Ghamidi Sahib? Then why do you have a different opinion on that?

    So If the witness is not at the end of the iddah Then the talaq will not count?

    Divorce also requires witnesses when pronounced. I heard from Ghamdi saab team. I do not know why in the same school there is a big difference on this. Dr lrfan may need to consult with his peers before commenting anything.

      And if it was not witness around When prononcing Then it is not valid?

      Apologies if my comments felt offensive.

      We are all seeking knowledge. Just read that ibn Abbas has also ruled that without witnesses there is no divorce.

    Yes it is not.

    It is invalid if pronounced after sex, during messes or in anger or revenge mood. 

    But be careful it’s not a light thing to do over and over.
