Assalamu Alaikum. I need guidance regarding talaq. I recently had my Nikah, and I have been suffering for about a year from intrusive/obsessive thoughts and waswasa—for example, taking excessive time with wudu/ghusl and imagining that I might cause an accident while driving.
Since my Nikah, I have repeatedly had unwanted divorce scenarios/thoughts. Sometimes the words “I divorce you” occur only as an inner voice; I usually cannot tell whether my lips moved or whether it was only in my mind. On a few occasions, while imagining a hypothetical future argument, I believe the words may have come from my mouth. I was actively trying to resist the thoughts and did not make a settled decision to divorce my wife. Immediately afterward I would reject the thought and become extremely distressed; on one occasion I even hit my head in panic.
My wife was not present during some of these episodes. In one restaurant episode she was sitting beside me, but I am not certain whether she actually heard me or even whether the words physically came out, because they were very low/inside my mouth.I immediately hit my head.I have never sent her a divorce message or written a divorce statement to her and sent it. I genuinely want to remain married and work on the relationship.Also I always remind myself Allah dislikes it and I would make it work by Sabar, silence and praying to Allah
My question is: In these circumstances, do any of these thoughts or uncertain/uncontrolled utterances constitute talaq? Is my Nikah still valid, and should I simply disregard these thoughts and continue treating my wife as my wife?
Please also clarify whether an explicit talaq phrase uttered during overpowering waswasa, without a settled decision or genuine desire to divorce, is legally effective according to your understanding of Islamic law.
