Questions On Tanseekh-e-Nikkah
Follow up from previous question titled “Khula”
I just want to give a sound illustration to take my point home.
Here is the thing:
If any wife out of millions we have in Pakistan decides to bully/take revenge on/ exert control over his husband what will happen.
The husband is bound to bear her financial responsibility unless she asks for a khula, which is her prerogative
The husband has to bear the financial responsibility of the children even if she takes them with her in a separate home.
The wife doesn’t have to obey the husband, if she disobeys no one can stop her.At this point,
You guys usually point out “oh but marriage is a social contract and the society should step in”Lets visualize society stepping in:
First go with family, assume a woman has a lawyer, can her or the guys parents do anything to stop her? Assuming that her parents are not with her on this, which would seldom be the case.
Usually, the woman’s parent’s would support her no matter what
Secondly, lets take courts. Courts are bound by laws. There is no law at least in my knowledge that forces the wife to bear anything. If there is please enlighten me?
