  • Zina Punishment (Adultery/Fornication)

According to Javed sahab, the maximum punishment of a 100 lashes (based on the severity of the crime and the criminals circumstances) mentioned in Surah Noor, is essentially for adulterers. However, verse 3 of Surah Noor ; “(After this punishment) This zani can only marry a zania or a mushrik, and this zania can only be wed to a zani or a mushrik. They have been forbidden for those who have faith.” appears to be directed towards fornicators and not adulterers, contrary to what Javed sahab says.

So, for whom is this punishment for?

    1. Is it for the adulterers who, if divorced or widowed, can now only marry an adulterer/adulteress/mushrik?

    2. Is it for both, adulterers and fornicators?

Javed sb had said in one of the lectures on rajm that the punishment of 100 lashes is essentially for adulterers, fornicators are punished as a per the principle of sadd e zariya. However, in my opinion, it can be agreed to be for both, but not exclusively for adultery.

The verse of the Quran is very explicit and there doesn’t seem any room differentiating the punishment solely on the basis of being married and unmarried. Marital status will be considered while deciding the severity of the crime and circumstances of the perpetrator, among other things, and it may or may not become a reason for relaxation in the punishment while announcing the final verdict. However, when the punishment is executed, the person is a convict in the eyes of the law, irrespective of the person’s marital status, the restriction for marriage of a convicted adulterer/fornicator applies equally to the convict in his/her status as a convict and not as a married or an unmarried convict.

Yes but according to Javed sahab, fornication can be (not has to be) punished as per Sadd e Zaria as mentioned by brother Abdullah. Javed sahab does not see the 100 lashes punishment as prescribed for fornicators. However, the succeeding verse seems to paint a separate picture. Hence the question.

Why do Muslim leaders say that the punishment of zina for a married man/woman is ‘stoning till death ? From where they got this concept?

From gross misunderstanding and a complete lack of understanding of legal procedures.

Please follow the following thread to understand from where traditional scholars have extracted this punishment of rajam (stoning) for married couple. Ghamid Sahab has discussed all the major narrations in this regard in the videos posted in this thread:

Can someone please point me to where Ghamidi Sahab has exactly made this statement: “fornication can be (not has to be) punished as per Sadd e Zaria”.
