  • Validity Of Marriage In Case Of Pre-marital Affairs

According to Surah noor, ayat 3, marriage between chaste and fornicator is haram. A marriage took place between chaste woman and unchaste man. The chaste woman was unaware of the ayat/ruling and her guardian didnt find anything about man having such kind of character. After 3 years, woman found out her husband wasn’t chaste and this ruling as well. Is marriage valid? Do they have to renew nikah. If Ghamidi sahab or other senior members of Al-mawrid would reply, I would be grateful. The couple are really distressed.

The marriage is valid. The ruling relates to an adulterer who has been punished by state for that act of adultery and has been declared an official criminal in this regard. This doesn’t have to do with every unreported case of adultery. However, the party guilty of adultery needs to repent sincerely and should never engage in such activities.
